The High Court in Bundung might soon discharge businessman Bubacarr Bob Keita on a procedural error allegedly caused by senior state counsel Alasan Jobe.
The CEO of Fire Protect Gambia Ltd. is standing trial for allegedly raping his now ex-wife's underage sister resulting in pregnancy.
An insider at the AG Chambers disclosed to What's On-Gambia: "Bob might soon be released from prison on a procedural error in the handling of the case"
But a legal expert, who begged for anonymity, argued that not all procedural errors are fatal in criminal matters. He said: "I don't know what the issue is, but it's normal for errors to happen in criminal cases."
He added: "I think for Keita's case, it would be very difficult to proceed in the absence of a DNA to establish whether he's the father of the child. There was no witness when the alleged rape happened and the girl was in a relationship with another young man."
A law student who was contacted by What's On-Gambia explained: "Criminal cases collapse on two things that's either on the strength of the substantive evidence or technicality. You can have all your evidence, but you may fail due to technicality."
Bob is still languishing at the Mile 2 prison, waiting for his case to continue at the High Court in Bundung.
